Last updated: 4 July 2026 (draft). A working draft scaffold. Must be reviewed and completed by a qualified lawyer before publishing — especially the data-export/offboarding and agency-detach sections, which are your brand promise in writing.
Ontabee, operated by Technoduces Info Solutions Pvt. Ltd. (Coimbatore, India), provides a multi-tenant online ordering and restaurant operations platform. Two plans: Free (commission-free ordering with the Ontabee mark on your pages) and Pro (fully white-labelled, priority support, advanced features). [Define the precise service scope of each plan with counsel.]
Ontabee does not take a percentage of your order revenue. Your payments run through your own configured payment provider and settle directly to you. This commitment is a core term of the service. [Lock the final wording with counsel.]
The core is free. Pro is $49/month per location, billed monthly, no minimum term, cancellable any time. Setup is free for restaurants migrating from GloriaFood. [Payment terms, taxes, and refund policy — complete with counsel.]
Your account data and your customers' data belong to you. You may export all of it at any time in machine-readable JSON from the dashboard. On cancellation you have a 30-day offboarding window to export; we then delete or anonymize your data, retaining only what tax and accounting law requires (7 years for financial records). This anti-lock-in commitment is a core term, not a courtesy. [Finalize the offboarding wording with counsel.]
Providing accurate information, configuring your own payment/SMS/email providers, complying with applicable law (including tax and food-service regulations), and the content of your menu and communications to your customers.
Don't use the service to break the law, sell prohibited goods, send spam or unsolicited marketing, infringe others' rights, probe or disrupt the platform's security, or misrepresent who you are. We may suspend accounts that put other tenants, diners, or the platform at risk — with notice where practicable, immediately where necessary. [Tighten the prohibited-use list with counsel per your jurisdictions.]
We target 99.9% monthly availability and operate redundant infrastructure, monitoring, and tested backups, but the service is provided "as is" and no uptime is guaranteed. To the maximum extent the law allows, our aggregate liability is capped at the subscription fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential losses (including lost sales during downtime). Nothing limits liability that cannot lawfully be limited. [This clause in particular must be drafted and localized by counsel.]
Agencies managing restaurant sub-accounts: this section governs what happens when a restaurant leaves an agency — which data and assets travel with the restaurant (its operational data) and which remain agency-owned (e.g. app-store listings under the agency's developer account), plus billing transition. This is the section most likely to cause disputes later — draft it carefully with counsel and reflect it in your agency agreement.
You can cancel any time from the dashboard — Pro simply stops renewing; there's no notice period or exit fee. We may terminate for material breach of these terms with 30 days' notice (immediately for serious abuse or non-payment after dunning). On termination in either direction, the data-export and deletion terms above apply: 30 days to take everything with you, then deletion per the retention schedule.
These terms are governed by the laws of India, and disputes fall to the courts of Coimbatore, Tamil Nadu, where Technoduces Info Solutions Pvt. Ltd. is registered. [Confirm with counsel, including whether enterprise/GCC customers need a separate governing-law annex.]
